PURCHASE/RETURNS/CANCELLATION POLICY:

PURCHASE:
We believe in offering the very best value, quality, and selection. Plus, we want you to enjoy your purchase.

Every order that you place on our Site will be subject to acceptance in accordance with these Terms of Sale. The final details of your order will be listed during the checkout process.  Following completion of the checkout process, we will send you an email confirming receipt of your order, detailing the products you have ordered with an order number, and setting forth the shipping address and delivery method for your order. This email is not an order acceptance from us, and your order will not be completed and accepted until we notify you that it has been shipped. Some (very few) items may require additional "over-sized" shipping fees. If so, we will notify you by email, an explanation of the extra fee, and you can either accept or cancel the order. You must accept the added charge by replying to the email saying you have read and agree to the added fee. If you wish to cancel the order, no problem, the sale will be cancelled and the "pending" charge will void. If we do not get in contact with you by phone or email, your order will be automatically cancelled without shipment.  We explicitly reserve the right not to accept your order for any reason. We also reserve the right to cancel a "Contract" by written notice to you in the following situations, without being liable for any damage or costs other than repayment of any amount received from you in relation to the Contract that we cancelled:

the Product you ordered is not available / in stock;
your billing information is not correct or not verifiable;
your order is flagged up by our security systems as an unusual order or an order susceptible to fraud;
there was an error in the price displayed on the Platform;
we could not deliver to the address provided by you;
due to an Event Outside Our Control (see below); or
in the event of misspelling, pricing or other errors or mistakes in the Platform information.

Once we have processed your order, we will send you another email confirming that your order has been shipped (the "Shipping Notification"). You should save the shipping notification for your own records. The Shipping Notification will be deemed to be completion of your purchase contract. Any products on the same order which we have not confirmed in the Shipping Notification will not form part of that contract. Completion of the contract will also not take place where we have notified you that we cannot accept your order. If your order is shipped via USPS,UPS, or Fed-EX, we will send you a tracking number in the Shipping Notification so you can track your purchase. We reserve the right to cancel any order and/or prevent access to the Site at any time, with or without cause.


RETURNS: In the event you wish to send a product to us, you may return the unopened/unused/undamaged item(s) for a refund or exchange within 30 days from the date of purchase. Buyer is responsible for all shipping fees (actual cost we paid to ship the item(s) to you "customer" and shipping fees to return the item from customer to us (OUTKAST FISHING TACKLE).  All returned items, must be unopened, unused, undamaged, and in original package with all contents. If items returned are not within these limitations, the return will be refused and no refund will be issued. All returns require a return authorization number which must be present on the outside of the return package. Please request your return authorization number by contacting us at 562-371-8023 or [email protected] to ensure your return or exchange is documented and any potential questions have been answered prior to the return. A return authorization number will be provided to you and is required before you ship any items to us. We recommend you send your return with tracking and insurance incase lost or damaged items during shipment. If something is lost/damaged, the customer will need to file a claim with the shipping company if they wish to receive payment for the lost/damaged items. If a package is sent to us with missing or damaged items, you will not receive credit or a refund. For additional information see below for "exceptions and exclusions".

EXCEPTIONS & EXCLUSIONS: If your order arrives damaged or missing items, you must notify us immediately and we may require picture(s), statement(s), and full assistance with filing the loss/damage claim as required with the shipping company (i.e. usps, fed-ex, ups, private courier, etc). If you do not contact us immediately or do not assist as needed with fling the claim, you may be denied a refund or exchange. Any items received and not immediately reported as damaged/lost, will be determined you received all items as "new and as described".

Due to the type of items we sell (fishing tackle) several of the items can and do become damaged during normal use, including but not limited to, rods, reels, lures, tackle bags, kill bags, hoop nets, landing nets, fighting belts, and gaffs. If you believe a product is or has becomes defective, you shall contact the manufacture for that particular product(s). Products with the brand name "PREDATOR" on this site are sold in brand new condition. All “PREDATOR” items are sold in "as-is" condition, without and warranty and the California "implied warranty" law does not apply due to the nature of use of these items.

CANCELLATIONS: We try to ship your order as quickly as possible, so once your order has been processed we are no longer able to cancel or modify it. If necessary your order may be returned or exchanged as described above.

Several items on this site will say "this item qualifies for free shipping". That means, there is no over-sized shipping fee for that item (very few items are considered over-sized). Orders are eligible for free shipping once 89.00 or more is purchased, excluding the cost of any over-sized items

LOST/DAMAGED ITEMS:
If shipment to customer is lost or damaged in shipment, customer must report the loss/damage upon receipt, must retain possession of any/all items (including package until notified otherwise  by email, and may be required to assist with filing a claim such as email, photos, and a signed affidavit if required by the shipping company.
